Existing rules from the Working Time Directive:

  • The 48-hour rule: Employees may not work more than 48 hours per week on average within any period of four calendar months. In 2017, the Supreme Court ruled that employees are generally entitled to DKK 25,000 in compensation if this is exceeded.
  • 11-hour rule: Employees must have 11 consecutive hours of rest within 24 hours. Employees are therefore allowed to work a maximum of 13 consecutive hours.
  • Employees are entitled to a weekly day off

The new rules from the Working Time Directive:

  • Registration. Companies in EU member states, including Danish companies, must have a system to record working hours on an accurate and reliable basis.
  • Enforce. All employees in member states must be able to enforce their rights to maximum working hours and rest periods.
  • Control. The system must be available for control efforts to ensure compliance with the requirements of the directive.
